Fictions were invented by the Roman praetors who, not possessing the power to abrogate the law, were nevertheless willing to derogate from it under the pretense of doing equity. Fiction is the resource of weakness which, in order to obtain its object, assumes as a fact what is known to be contrary to truth: when the legislator desires to accomplish his object, he need not feign, he commands. Fictions of law owe their origin to the legislative usurpations of the bench.

Police Have NO Duty To Protect Individuals
Posted: 10th January 2011 by Marc MkKoy in Legal Commentary, Legal Tidbits, Political CommentaryThere is much ado, particularly where I live in St. Clair County, about budget shortfalls and the resulting lay-offs of police. The media is commenting on possible “safety” issues and residents express concern over lack of protection. In reality, there is no protection by police. That is not their job. If it were, then there would be some remedy at law for their failing to protect anyone. People have made such a claim in the past and the courts have opined on the fallacious belief that police are for anyone’s protection.

Posted: 3rd January 2011 by Marc MkKoy in Abusive Government, Commentary and Opinion, Featured, St. Clair County CorruptionGetting the new year off on the right foot, I am embarking on a mission to address issues which remain from my arrest and beating by Fairview Heights Police on Feb. 17, 2009 and the criminal actions of Joshua Alemond and Aaron Nyman. Along with those criminal acts, the refusal of government “officials” to apply the law against these men for their criminal deeds. Taking this premise further, the system of abuse, misfeasance, and malfeasance by “officials” in one of the most corrupt counties in Illinois, St. Clair County.

Limited Time Offer to Government has Expired

Well, there have been zero responses from ANY governmental body to my offer. Upon reviewing the server logs and inspection thereof reveals a number of agencies that have visited my site, but failed to accept my offer. I have had the IRS, DOJ, State of Illinois, and other lesser bodies visit my site, but aside […]
Do Away With Tyrants By Not Voting.

Do Away With Tyrants By Not Voting. “.….deriving their just powers from the consent of the governed.…” How many people consider the significance of those ten words? I could write an essay on each one of them. It is disturbing to see how the Declaration of Independence is generally dismissed. There are areas of study […]

The husband and wife are secondary or inferior parties. The Secular Contract is a three– way contract between the State, as Principal, and the husband and wife as the other two legs of the Contract.
The real slumlords — Government leading by example
Posted: 8th October 2010 by Marc MkKoy in Political Commentary, Social Commentary, Theft through "Occupancy and Safety".The City of Collinsville, Illinois recently abandoned an ordinance which would have forced landlords to open their tenants doors and private lives to government intervention and inspection; requiring tenants to apply for and receive a occupancy permit to inhabit an apartment. It would also have forced private home owners to procure the same permit by […]

The best advice is, if you cherish your privacy and 4th Amendment protection, is to not apply for the permit and stand your ground in court.
Email exchange with Brendan Kelly, Circuit Clerk of St. Clair County.
Posted: 20th September 2010 by Marc MkKoy in Abusive Government, Legal Commentary, Meet Brendan Kelly, Political Commentary, St. Clair County CorruptionAs a matter of course, criminal charges of any type either felony or misdemeanor are initiated by the State’s Attorney or grand jury in our case management system. Since the documents you filed with my office were not filed by either entity, and because some record was required, those filings were assigned case number 10-MR-212.

An email tete’-a-tete’ between myself and some family members.
Posted: 24th July 2010 by Marc MkKoy in Social CommentaryAn email tete’-a-tete’ between myself and some family members. Analysis of the Barak Obama Speech on Race
Posted: 24th July 2010 by Marc MkKoy in Social CommentaryObama, my nigga’! I respect your feigned attempt at illustrating the racial divide that has been eating away at this country’s cultural psyche and that which is now culminating with the triangulation of hate, nationalism, and racism fed by the fuel of “illegal immigration” tossed capriciously upon the smoldering heap of racial discord. You may believe […]
I got “census’d” today. What fun! No, I did not participate. I talked to the census taker for about 45 minutes. She was pleasant and professional. I did not answer her questions except for telling her, for purposes of a Constitutional census, the number of people is “two”. I declined my name, phone number, race […]
Common Law in Illinois
Posted: 23rd May 2010 by Mark McCoy in Commentary and Opinion, Philosophical Foundations of Government, Philosophical Foundations of LibertyTags: citizenship, common law, sovereignty
As a result of the Act, the great body of the English common law became, so far as applicable, in force in this state, and remains in force except so far as it has been modified or repealed by statute, or changed or modified by custom as found in decisions of our courts. The common law, when applicable, is as much a part of the law of the state, where it has not been expressly abrogated by statute, as the statutes themselves. In other words, Illinois is a common law state.
